Description: In 2019 Dan successfully defended an employee of the local marijuana industry against a charge of speeding and driving under the influence of drugs. After working in a legal grow house, Dan's client was followed from her place of employment onto the interstate. When she accelerated to pass a vehicle hauling a trailer that was swaying, she was pulled over for speeding and charged with DUID. At trial, Dan was able to get the officer to admit that he had been waiting outside the facility, that our client had no marijuana in her possession, that there is a difference between the smell of fresh marijuana and burnt marijuana and that the smell of burnt marijuana can linger long after any effects of the marijuana have worn off. The jury took only 40 minutes to acquit the client of both DUID and speeding.
